TERMS OF REFERENCE

CONTRACTING A CONSULTANT TO CONDUCT A RESEARCH AND REPORT FOCUSED ON THE IMPACT OF CORRUPTION ON WILDLIFE TRAFFICKING.

I. Program Background

The Program Combating Wildlife Trafficking to Prevent Organized Crime in the Andean Region (hereinafter, the Program), implemented by the American Bar Association - Rule of Law Initiative (hereinafter, ABA ROLI Peru) seeks to strengthen the legal and technical capacities of justice operators and the entities of the Executive Branch related to the protection of wildlife and hydrobiological resources, through the effective investigation, prosecution and trial of crimes that affect them.

The Program is a cooperative effort funded by the Bureau of International Narcotics and Law Enforcement Affairs - INL, of the United States Department of State.

In this context, a research and report focused on the impact of corruption on wildlife trafficking is planned, in the framework of which the services of a consultant will be hired.

II. SCOPE OF PROGRAM ACTIVITIES

The activities carried out through the Program are national in scope and are aimed mainly at operators in the criminal justice system: the Judicial Branch, the Public Prosecutor's Office, the Public Prosecutor's Office and the Peruvian National Police, as well as Executive Branch entities involved in the protection of wildlife and hydrobiological resources.

Along these lines, we have the following objectives:

  1. Increase the capacity of key operators in the justice administration system to identify, investigate and prosecute wildlife trafficking offenses.

  2. Improve the capacities of national and regional operators responsible for combating wildlife trafficking to apply collaboration, cooperation and information exchange tools in the cross-border fight against international wildlife trafficking networks.

DEFINITION OF THE GEOGRAPHIC SCOPE OF THE PROGRAM'S ACTIVITIES

The Program focuses its efforts on three types of zones:

a) Extraction zone: Localities or departments in which the specimen is extracted from its habitat. Generally, it includes jungle areas in the case of wild fauna.

b) Collection zone: Referred to the main cities in the areas of the departments in which the specimen is extracted.

c) Export zone: Refers to the border zones through which the resource is exported. Lima and Callao are included, because they are a locality that concentrates the specimens, prior to their illegal exit through the port or airport.

The following departments are included:

· Puno

· Tumbes

· Cusco

· Mother of God

· Ucayali

· St. Maarten

· Loreto

· Lima and Callao

III. PURPOSE OF THE CONTRACT

Engage the services of a consultant to develop a research and report focused on the impact of corruption on wildlife trafficking.

IV. CONSULTING OBJECTIVES

5.1 General Objective

The consultant shall conduct an investigation (desk and field) to determine the impact of corruption on wildlife trafficking. To this end, the consultant shall identify the wildlife licensing and control procedures that present fragile points or bottlenecks, susceptible to being affected by corruption, as well as the services available to citizens focused on the presentation of corruption complaints.

In accordance with the environmental management and control competencies in force, the study will include the analysis of central government entities, as well as the relevant regional governments.

V. SCOPE OF SERVICE

The consultant shall carry out an investigation in accordance with the terms set forth in the objective of this document.

As part of the service, the consultant shall deliver:

· Research report: It will include the diagnosis, conclusions and recommendations of the investigated phenomenon. Likewise, all information obtained within the framework of the investigation, which allows supporting the conclusions indicated, must be attached.

· Executive summary: It will contain the findings of the research, in the form of an executive summary. This should be a diagrammed and publishable version, in order to be transferred to the main operators of the justice system, administrative authorities and citizens in general.

As part of the service, the consultant shall hold the following meetings on a mandatory basis:

· Project kick-off meeting: in order to deepen and broaden the objectives and scope of the research, as well as to answer all necessary queries.

· Follow-up and progress meeting: on a biweekly basis, the consultant shall hold a meeting with ABA ROLI, in order to show progress in relation to the service.

VI. CONSULTANT PROFILE

The consultant may be a natural or legal person, as long as it complies with the requirements set forth in these terms of reference and the contract to be signed with ABA ROLI.

The consultant must have experience in the study or investigation of corruption in Peru. It is desirable, although not mandatory, that he/she has knowledge of the regulations related to the use and control of wildlife and hydrobiological resources.

The consultant shall comply with the accounting and tax characteristics required by ABA ROLI. For the purposes of the terms of reference shall be referred to as "the consultant".

VII. PLACE OF SERVICE PROVISION

Given the nature of the services, it is not necessary for the consulting firm to be physically present at ABA ROLI PERU's offices.
