COMMERCIAL LAW (Co-Facilitator)

1. BACKGROUND:

The Rule of Law Initiative (ROLI) is a public service project of the American Bar Association (ABA) dedicated to promoting legal reform efforts in approximately 50 countries around the world. The Rule of Law Initiative believes that rule of law promotion is the most effective long-term antidote to the most pressing problems facing the world community today, including poverty, economic stagnation, and crippling levels of corruption. The Rule of Law Initiative concentrates its technical legal assistance efforts in the following substantive areas: 1) Anti-corruption & public integrity; 2) Criminal law & combating trafficking in persons; 3) Gender issues; 4) Human rights & conflict mitigation; 5) Judicial reform; 6) Legal education reform; and 7) Legal profession reform. The Rule of Law Initiative enlists talented individuals who possess the skills and commitment necessary to effectively promote the rule of law in our host countries.

ABA ROLI currently implements the Legal Partnership Initiative (LPI) in Northern Africa, which aims, in part, to provide continuing legal education opportunities to the legal and civil society communities in the region.

2. NATURE OF THE CONSULTANCY:

ABA ROLI seeks a co-facilitator (bar expert) to conduct a two-day training on commercial law, covering potential topics such as corporate law and governance, Uniform Commercial Code (UCC), business entities, antitrust laws relevant for the region, financial regulation, trade law, alternative dispute resolution in relation to commercial law, etc. against the backdrop of salient local/regional laws and international and/or regional norms and best practices.

3. OBJECTIVE:

ABA ROLI is seeking co-facilitator to 1) work closely with the ABA expert and the Local Program coordinator in order to develop a training curriculum, with a heavy preference for French or Arabic speakers, who can produce materials in French or Arabic AND English, that is tailored to the existing regional context and international laws on training on Commercial Law, 2) assist in conducting a two-day training in the region, and 3) provide and final report that is inclusive of pre/post tests and their respective participant scores, a training agenda, training curriculum, training attendance reports, recommendations for future training events, and report on how the training went.

ABA ROLI is working with local counterparts to identify a local co-facilitator for this event; it is envisioned that the co-facilitator and ABA training expert will coordinate training efforts and serve as resources for one another.

4. MAIN TASKS/FUNCTIONS

The Trainer will work alongside ABA ROLI’s project management unit, Program Coordinator project, representatives from local and regional bar associations, etc. to undertake the following activities:

  • Review and become familiar with international and regional Commercial Law and norms;
  • Help to Create a training agenda and work with local counterparts to finalize the course contents;
  • Work with the Local Program Coordinator and focal points within the Bar Association, if available, to promote localization;
  • Develop a training curriculum in English, but preferably in English AND French or Arabic;
  • Develop a pre and posttest for the training and administer/score the tests as part of the final reporting;
  • Circulate and collect an attendance sheet for each day of training;
  • Coordinate, if needed, with ABA ROLI setting up training logistics;
  • Draft a report that is inclusive of the aforementioned deliverables and also details what went well, what could be improved, recommendations for future training interventions, etc.; and
  • Any other responsibilities as assigned.

5. REQUIRED QUALIFICATIONS AND EXPERIENCE:

  • University degree in law or relevant field; an advanced degree would be an advantage;
  • Ability to work independently but also as part of a facilitation team;
  • Demonstrated analytical, research, reporting, communication, documentation, and presentation skills.
  • Experience in pedagogy or teaching processes;
  • Familiarity with the Microsoft Office Suite and online meeting tools (e.g., Zoom, Teams, Skype, etc.);
  • Excellent ability to summarize, write, and explain complex content in a simple manner;
  • Ability to develop innovative training materials using technological resources; and
  • Regional or local experience will be an advantage.

Desirable competencies for all applicants:

  • French and/or Arabic fluency will be highly prioritized; and
  • Experience working with local counterparts to provide contextualized training.

6. TIMING AND LOCATION

ABA ROLI plans to conduct this training in Winter 2022/Spring 2023 in North Africa. The specific country will be disclosed at a later stage of the recruitment process. ABA ROLI anticipates this consultancy will be for approximately 8-10 days, inclusive of travel.
