Cambodia: Short-Term Legal Consultant, Women’s Economic Empowerment

ABA ROLI is seeking an expert to assist with an assessment of barriers to women’s economic empowerment in Cambodia. The assessment will seek to identify legal and policy barriers that young women entrepreneurs face in financing, starting up, growing, and sustaining their businesses. The findings of the assessment will present rigorous, qualitative analyses of data on the complex interplay of national laws, policies, and practices that have an impact on female entrepreneurship in Cambodia and will be used to inform future women’s empowerment initiatives in the country. ABA ROLI is seeking an expert with a law degree and background in commercial, trade, banking/finance or other regulatory law (at least 2-3 years of experience). Bilingual Khmer-English lawyers are strongly preferred. Experience in legal analysis in the Cambodian context, international and human rights law, and women's economic empowerment or gender programs/studies are a plus. ABA ROLI has developed the methodology for the assessment, which includes the following:

  1. D*e jure* (textual) analysis of pertinent laws, policies, and pending draft legislation vis-à-vis international and comparative legal standards; and

  2. D*e facto* (contextual) analysis derived from secondary materials and field research consisting of key informant interviews with a cross-section of stakeholders, including women’s rights experts, government officials, representatives of international and civil society organizations, as well as lending (e.g., microfinance) institutions, justice system actors, lawyers, service providers, journalists, and other observers who have unique insights into women’s economic empowerment in Cambodia.

The full scope of the assessment is defined in ABA ROLI’s methodology, which also includes concrete questions to be answered by the implementing expert. By way of example, these questions will seek to explore such issues as women’s legal autonomy; property, land, and inheritance rights, financial inclusion and access to credit; and access to justice.

The short-term legal consultant will assist with the following:

  • November 2018: assist in collecting pertinent laws and policies (as well as secondary materials where appropriate) for Cambodia in line with the ABA ROLI-developed methodology. Analyze relevant laws and policies in light of pertinent international and comparative legal standards, with an aim of fully or partially answering the questions listed in the methodology. The analysis should be written in English.

  • December 2018: Using the ABA ROLI-developed assessment methodology, and with guidance and instruction from ABA ROLI experts, conduct in-country key informant interviews in Phnom Penh and possibly 1 other urban location). Submit detailed interview notes (in English) on ABA ROLI-provided template.
