TIP (Trafficking in Persons) Expert Trainer

Program Summary: For 25 years, ABA ROLI has partnered with national governments and local organizations in nearly 100 countries to find sustainable solutions that promotes justice, economic opportunity, and human dignity through the rule of law. ABA ROLI emphasizes a collaborative approach that responds to local needs, empowering its actors and prioritizing sustainable solutions to urgent rule of law challenges.

ABA ROLI’s program in Barbados, Combatting Human Trafficking in Barbados, is funded by the USAID Human Rights Support Mechanism (HRSM) and is a project of the PROGRESS consortium. Our program aims to raise awareness and build the capacity of judges, magistrates, and prosecutors in-country to address trafficking in persons (TIP). The project’s objectives include:

  1. Raising awareness of TIP

  2. Improving investigations and prosecutions of TIP

  3. Building a strong consolidated approach to address TIP in-country among key stakeholders

Consultancy Summary:

The consultant will be responsible for the following deliverables:

  1. Providing input and feedback to a 2-day TIP training curriculum for judges and prosecutors, in coordination with local expert consultants, by end of January 2021.
  2. Facilitating, in coordination with local expert consultants, 2 training sessions on human trafficking for 2 trainings from end of January to early February 2021. The training sessions will be 1.5 hours each and will be conducted virtually.
  3. Provide expertise and comments and serve as a reviewer for a Training of Trainers (ToT) manual for judges and prosecutors by end of February 2021; and
  4. Provide expertise and comments and serve as a reviewer for a prosecutorial guide for TIP crimes in the Caribbean with local expert consultants by end of February 2021

The duration of this consultancy is up to 12 working days.

The purpose of these workshops, manuals, and guides is to strengthen judges’ and prosecutors’ capacity in Barbados to adequately detect trafficking cases, and effectively implement anti-trafficking legislation in line with national and international legal frameworks. The specific areas to be covered in the training workshop include:

· The scope and magnitude of TIP;

· How human trafficking is defined;

· The causes and indicators of TIP;

· Current perspectives and trends in relation to TIP;

· National and international law on TIP;

· Investigative techniques;

· Witness interviewing using a victim-centered, trauma-informed approach;

· The prosecution of trafficking crimes;

· The application of sentencing guidelines in trafficking cases;

· The role of the court in the prevention of retaliation against trafficked victims.

· Nexus of TIP with other organized crimes.

Compensation: Commensurate upon experience.

Basic Qualifications:

  • J.D. or equivalent professional legal qualification (i.e. qualified to practice at the Bar)

  • 15 years practicing experience as an Attorney-at-Law;

  • Demonstrated experience in training judicial officers and prosecutors;

  • Commitment to rule of law.

Preferred Qualifications:

  • J.D. preferably from a Commonwealth jurisdiction.**

  • Experience working in the Latin American and/or Caribbean Region **

Responsibilities:

The consultant, in coordination with ABA ROLI, will be expected to train judges and prosecutors in one of the following training sessions:

  • Admissibility of evidence in TIP cases;

  • Adjudicating transnational TIP cases;

  • Interpreting and applying forfeiture and confiscation provisions;

  • Court-room management for vulnerable TIP victims and witnesses

  • Sentencing of TIP perpetrators;

  • Adjudicating official complicity in TIP;

  • Adjudicating the commission of TIP by legal persons.

Trainers will receive from ABA ROLI an induction to use the virtual platform, so that they can prepare their presentations and teach the course with ease.
