DESCRIPTION: Individual Consultant/Analyst for National-Level Legal and Policy Analysis on Children’s Right to Safe and Healthful Conditions of Work in the Philippines

Background:
The goal of the Against Child Exploitation (ACE) Project is strengthened capacity of the government to address the worst forms of child labor (WFCL), including the online sexual exploitation of children (OSEC), and violations of acceptable conditions of work in the Philippines and another country in Asia. ACE will help the government popularize the law to ensure a better understanding of what is acceptable child work and what is prohibited for children. Conditions of work for allowable child work will also be explained so that any violations can be prevented. The project will contribute to achieving this goal through working towards three long-term outcomes: 1) Improved enforcement of the legal framework pertaining to WFCL, including OSEC, and violations of acceptable conditions of work in the Philippines and another country in Asia; 2) Improved assistance services for victims of WFCL, including OSEC, and violations of acceptable conditions of work in the Philippines and another country in Asia; and 3) Strengthened partnerships to accelerate progress in addressing WFCL, including OSEC, and violations of acceptable conditions of work in the Philippines and another country in Asia.
Purpose:
ABA ROLI seeks an Individual Consultant/Analyst (“Analyst”) who can, on a remote basis, conduct a national-level legal and policy analysis of minimum standards for occupational safety and health (OSH) to uphold children’s right to safe and healthful conditions of work, and the review and analysis of child work vs. the worst forms of child labor (WFCL), in the Philippines. (“Analysis”).
Detailed Scope of Work:
Diagnosis Phase:
The Analyst will be expected to engage stakeholders (government, civil society, private sector, and community members) to understand gaps in policy implementation, service delivery, and the localization of laws.
- The Analysis will identify key actors; map existing labor laws and policy frameworks, enforcement structures, systems, and processes; and identify gaps in the enforcement of laws and policies.
- The Analysis will include a review of relevant laws; formal enforcement structures, policies and approaches; reports that identify gaps in enforcement; additional research, testing and verification of previously identified gaps through interviews and focus groups with officials at institutions responsible for enforcing laws on WFCL, including OSEC, such as IACAT, IACACP, the Department of Justice (DOJ), the Inter-Agency Council for the Welfare of Children, the Philippines National Police (PNP), the National Bureau of Investigations (NBI), the Sagip Batang Manggagawa Quick Action Teams (SBM QAT), NCACL members, and DOLE, as well as labor inspectors, social workers, prosecutors, and judges.
- The Analyst will be expected to build on, and not duplicate, existing analyses—such as the International Labor Organization’s (ILO) International Program on the Elimination of Child Labor (IPEC) review of policy gaps of the NCACL.
- The Analysis will review current enforcement, identify what constitutes acceptable conditions of work, highlight hazards that can lead to and result in hazardous work (often a WFCL), focus on the lack of clarity among relevant institutions as to the definition of the online sexual exploitation of children (OSEC) as a WFCL, and explore how this lack of clarity impacts enforcement (its existing legal definition in the Philippines is as a form of trafficking in persons).
Reporting Phase: Final Report to Include Recommendations and Lessons Learned
The Analyst will be expected to liaise directly with ABA ROLI-Manila based staff and will report to the Philippines-based Country Director, with substantial involvement by ABA ROLI Headquarters (HQ) program staff.
The anticipated duration of the remote-based assignment is between eight and twelve weeks. The Analyst will work within the framework of the Department of Labor-funded “Against Child Exploitation (ACE) Project: Strengthening Communities in Asia to Address Child Labor through a Unified and Participatory Approach”.
QUALIFICATIONS
- Minimum of Masters degree in relevant area
- Excellent communications, analysis, reporting and writing skills
- Fluent in English, Tagalog an advantage
EXPERIENCE
- The Analyst should have significant experience in conducting similar analyses.
- Between five and seven years of relevant development experience combatting child labor, forced labor, and human trafficking.
- Excellent report writing skills, including the ability to synthesize ideas and present these in a clear and consistent manner understandable to non-specialist stakeholders.
- Previous work experience with Government agencies and/or donor-funded projects will be considered as an asset.
