JOB SUMMARY
With increased reports of Sri Lankan men, women and children migrating to regions being subjected to forced labor and forced prostitution, Trafficking in Persons (TIP) has emerged as a high priority issue in Sri Lanka. With support from the U.S. Government, ABA ROLI has established operations in Sri Lanka to provide support to the justice sector by strengthening TIP criminal accountability and advancing effective victim protection. ABA ROLI will be working with the Attorney General’s Department (OAG), the Sri Lankan Police Criminal Investigations Department (CID) and the Judicial Training Institute (JTI) to achieve this goal.
Pro bono Judicial Advisors/Trainers will support in the development and/or review of training resources. Jointly with the JTI[1], ABA ROLI will develop a training program that addresses, inter alia: global TIP caselaw and jurisprudence, role of the judiciary in shaping victim identification criteria, victim witness-centered judicial proceedings, victim and witness protection and assistance, strengthening the role of magistrates vis-a-vis guidance to law enforcement and active participation in the investigation phase, expediting TIP cases, and other issues identified as priorities by stakeholders.
Advisors/Trainers, along with global judicial trainers from the USA and the Philippines, will also co-facilitate the National Symposium for Judges in Colombo. The Symposium — tentatively slated for late February or mid-March — is envisaged to serve as a springboard for future TIP training of all Magistrate Judges in Sri Lanka and will utilize best practices in adult education, emphasize a victim-centered approach to TIP accountability, and underscore the importance of coordination among responsible agencies.
Please note: Although this is a voluntary position, ABA ROLI will cover the costs of travel and lodging. After the Symposium concludes, per diem will be provided to cover relevant costs.
RESPONSIBILITIES
Review and Advise (October 2018– March 2019)
- Compilation of case law and jurisprudence relevant to TIP from Sri Lanka, India, South Africa, Australia, UK, USA, etc.
- Case law governing specific legal elements of SL’s Penal Code section 360(c).
- Case law governing specific themes giving rise to common evidentiary challenges in TIP cases, i.e. victim consent, proving the trafficking chain, jurisdictional issues, etc.
- Annotated legal and evidentiary analysis of TIP related offenses.
- Breaking down key offenses by legal elements, type(s) of evidence (testimonial, documentary, real evidence).
- Breaking down source(s) of information that can prove each legal element of TIP and related offences.
National Symposium for Judges (November 2018-March 2019)
- Review and advise on the draft of the National Symposium program.
- Consult with counterpart Judicial Trainer in preparation for Symposium.
- Co-facilitate Symposium, jointly with a Judicial Advisor/Trainer from another country.
QUALIFICATIONS
- University degree in law, preferred with 15 or more years’ experience including adjudication of TIP cases
- Proven experience delivering/facilitating trainings and experience in the development/review of training materials
- Excellent intercultural communication skills and interpersonal skills with ability to quickly build rapport with senior government officials and prosecutors
- Organizational proficiency and excellent analytical and evaluate skills
- Previous experience working with criminal justice actors in developing countries
[1] JTI is the training body for over 75 High Court Judges (soon to be increased to 125) and 300 District Court Judges and Magistrates spread across the 25 Districts of Sri Lanka.
